Standard Parent Visas
These is relatively inexpensive visa but the annual quotas for places are much smaller than the number of the applications, so the waiting time is many years.
Parent, subclass 103
Main criteria:
- the primary applicant has a sponsor (child) who is a permanent resident or Australian citizen.
- at least half of applicant’s children must be permanently resident in Australia, or
- the applicant has more children living permanently in Australia than any other single country
- no substantial criminal record
- good health
Aged Parent, subclass 804
- the primary applicant has a sponsor (child) who is a permanent resident or Australian citizen.
- at least half of applicant’s children must be permanently resident in Australia, or
- the applicant has more children living permanently in Australia than any other single country
- no substantial criminal record
- good health
One also must
- be old enough to receive the age pension in Australia
- not have already applied for or hold a Sponsored Parent (Temporary) (Subclass 870) visa when applying for this visa
Note: A temporary concession to allow visas to be granted to applicants outside Australia is available to eligible Parent visa applicants from 24 March 2021.
Contributory Parent Visas
These applications involve payment of high fees around $50000 per person. The waiting period is much shorter then in case of the standard parent visas.
Contributory Parent, subclass c143
Main criteria:
- the primary applicant has a sponsor (child) who is a permanent resident or Australian citizen.
- at least half of applicant’s children must be permanently resident in Australia, or
- the applicant has more children living permanently in Australia than any other single country
- this application can’t be lodge while the applicant is in Australia
Contributory Parent, subclass 173 – temporary visa valid for 2 years
- The criteria are the same like for sc143. Application for this visa allows splitting the contributory charge for sc143 to two payments: for two years temporary visa, and for the permanent stage.
Main criteria for the sponsor:
- the settled permanent resident or Australian citizen.
- age 18 years or over (in case sponsor is under 18, his close relative, guardian or community organization may act as a sponsor)
- sponsor or other nominated person provides Assurance of Support including security bond
- Visa holder may during validity of the visa apply for permanent Contributory Parent, subclass 143 visa.
Contributory Aged Parent, subclass 864
Main criteria:
- the primary applicant’s age, at least 65 for man, 60-65 for woman-her eligibility age depends on the date of birth
- has a sponsor (child) who is a permanent resident or Australian citizen.
- at least half of applicant’s children must be permanently resident in Australia, or
- the applicant has more children living permanently in Australia than any other single country
- no substantial criminal record
- good health
Contributory Aged Parent, subclass 884 – temporary
visa valid for 2 years
- The criteria are the same like for sc143. Application for this visa allows splitting the contributory charge to two payments: for two years temporary visa, and for the permanent stage.
The holder of a temporary visa may, during the validity period of the visa, submit an application for permanent residence – visa – subclass 864.
Temporary Sponsored Parent subclass 870 Visa
The Subclass 870 visa is a temporary visa which allows a parent of an Australian citizen, Australian permanent resident or eligible New Zealand citizen visit Australia for up to three or five years. Unlike other parent visa sc117 and sc858 id doesn’t provide any pathway to permanent residency
It provides parents and grandparents with a pathway to reunite and spend time together, in Australia for a period of up to five years.
The 870 Visa is a two-step process:
- Apply and have approved Parent Sponsor before you can lodge an application for the visa
- Lodge your visa application within six months of the sponsorship approval
To be eligible for the visa, a parent must be:
- the biological, adoptive, or step-parent or parent-in-law of the parent sponsor,
- who must be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen
There is no balance of family test or Assurance of Support requirements for this visa.
Sponsors must meet the following criteria:
- sponsors will need to have a taxable income of at least $83,454.80
- the sponsor/parent relationship requirements (parent must be the biological, adoptive, or step-parent of the sponsor and a stepparent can only apply if they are still in a married/de facto relationship with a biological parent of the sponsor)
- be aged at least 18 years of age.
- be an Australian citizen/permanent resident or eligible New Zealand citizen who has been usually resident in Australia for four years
- have met any prior sponsorship obligations.
- have no adverse information unless it is reasonable to disregard the information
- have no debts to the Commonwealth or public health debts unless appropriate arrangements have been made for payment
- a minimum household income threshold (based on the income of the sponsor, or the combined income of the sponsor and their spouse/partner and/or another child of the parent)
- provide police clearances for any country they have spent more than 12 months cumulatively in during the past 10 years.
Sponsors must also agree to comply with sponsorship obligations in relation to the parent(s) they are sponsoring.
Sponsored Parent (Temporary) visa applicants must:
- be sponsored by a person who is an approved parent sponsor
- be at least 18 years of age
- provide evidence of access to funds
- provide evidence of health insurance
- not have an outstanding public health debt (unless appropriate arrangements have been made to repay the debt)
- satisfy health, character, and national security requirements.
