- The instrument LIN 24/059 specify India as a foreign country to enable applicants who hold a passport issued by India to be eligible to apply for a Subclass 462 visa.
- specify applicants who hold a valid passport issued by India are in a class of persons exempt from the requirement to provide evidence they have the support of the foreign government for the purpose of subparagraph 1224A(3)(b)(iii) of Schedule 1 to the Migration Regulations.
- specify the educational qualifications required for Subclass 462 visa applicants from India for the purpose of paragraph 462.221(c) of Schedule 2 to the Migration Regulations.
The instrument commences on 16 September 2024 and sets out the eligibility requirements for registration and other rules that apply to the conduct of a visa pre-application process for a Work and Holiday (Sc 462) visa.
The person holding a valid passport issued by a foreign country to which a Sc 462 pre-application process applies (at this stage this includes the People’s republic of China, India and Vietnam) and the person must be aged 18 and no more than 30 years as at the date of registration.
The instrument also has information on the registration open period, withdrawal of registration by a registered participant, duration of registration which outlines the circumstances where a registration will lapse these are the following:
- the end of the selection open period for that process (see section 14, below, for details of the selection open period);
- if the person is selected as a selected participant for that process – when the person is selected;
- if the person withdraws their registration as a participant in that process when the withdrawal is lodged (see section 11, above, for details of withdrawal of registration);
- if the person turns 31 before the person is selected as a selected participant for that process – when the person turns 31 (a person who is aged over 30 would no longer be able to satisfy the criteria for the grant of a Subclass 462 (Work and Holiday) visa under clause 462.212 of Schedule 2 to the Migration Regulations, and random selection under the process would no longer be of any benefit to the person in obtaining a Subclass 462 visa); and
- if the person dies before the person is selected as a selected participant for that process – when the person dies.
The instrument also has information on the selection of registered participants, the selection open period and when a selected participant must be notified if they are successful in being selected for a Subclass 462 (Work and Holiday) visa pre-application process, and the information that must be included in that notice.
